Terms of Service

These terms and conditions (the "Terms") govern access to and use of the Feen software, an AI-powered accounting tool published and operated by Pixl SRL. By creating an account or using the service, you accept these Terms in full.

1. Parties

The service is published by Pixl SRL, a Belgian private limited company registered with the Crossroads Bank for Enterprises under number BE 0805.449.693, with its registered office at Avenue Louise 231, 1050 Brussels, Belgium ("Pixl" or "we"). Any natural or legal person who subscribes to an account or a plan is referred to below as the "Customer" or "you".

2. Definitions

"Service" means the Feen platform available at app.feen.be, including associated features (accounting dashboard, bank synchronisation, electronic invoice issuance and receipt, integrations). "Account" means the Customer's personal workspace. "Customer Data" means all documents, receipts, entries and financial information transmitted to the Service by the Customer or its trusted third parties. "User" means any natural person using the Service on behalf of the Customer.

3. Description of the service

Feen is a SaaS (Software-as-a-Service) solution primarily aimed at Belgian small and medium-sized enterprises. Its features include invoice issuance, automatic reconciliation of bank transactions via PSD2, automated data extraction from receipts (OCR), preparation of accounting entries, and the sending and receiving of electronic invoices through the Peppol network. Feen is not an accounting firm; accounting and tax decisions remain the responsibility of the Customer and, where applicable, its chartered accountant.

4. Subscription, pricing and billing

Access to the Service is subject to a monthly subscription, with a launch price of €19 excl. VAT per month for the Starter plan. Prices are stated in euros, excluding applicable Belgian VAT (21%). Billing takes place at the start of each monthly period and is automatically charged to the payment method provided by the Customer. Any month started is due. Pixl reserves the right to change its prices subject to thirty (30) days' prior notice; new prices apply to the Customer from the next billing period.

5. Trial period

On first registration, the Customer benefits from a fourteen (14) day free trial, with no payment method required. At the end of the trial, the Customer may choose to subscribe to a paid plan; otherwise, access to the Service is suspended. Customer Data is retained for thirty (30) days after the end of the trial, after which it may be deleted.

6. Customer obligations

The Customer undertakes to provide accurate and up-to-date information, to use the Service in accordance with applicable laws and regulations, not to use the Service for fraudulent purposes, to keep credentials confidential, and to notify Pixl without delay of any unauthorised use. The Customer is solely responsible for the accuracy of the Data entered or imported into the Service, in particular for the purposes of its tax and social security filings.

7. Service availability

Pixl uses its best efforts to ensure service availability of 99% calculated on a monthly basis, excluding scheduled maintenance announced in advance and force majeure events. Maintenance operations are, where possible, carried out outside Belgian business hours. No strict performance guarantee is given; Pixl's obligation is one of means, not of result.

8. Data protection

The processing of personal data is described in detail in our Privacy Policy, available at feen.be/privacy. That policy forms an integral part of these Terms. As regards Customer Data containing personal data processed on behalf of the Customer, Pixl acts as a processor within the meaning of the GDPR.

9. Limitation of liability

To the fullest extent permitted by Belgian law, Pixl's total liability to the Customer, all heads of damage combined, is limited to the amount of subscription fees actually paid by the Customer during the twelve (12) months preceding the event giving rise to liability. Pixl shall not be liable for indirect damages, including loss of turnover, profits, customers or data, except in cases of wilful misconduct or gross negligence.

10. Termination

The Customer may terminate its subscription at any time from its customer area, with effect at the end of the current monthly period. Pixl may terminate the contract in the event of serious breach by the Customer, in particular for non-payment or fraudulent or unlawful use, after a formal notice that remains ineffective for fifteen (15) days. The Customer may export its data at any time during the contract and during the thirty (30) days following termination.

11. Peppol integration disclaimer

Feen is a Peppol Access Point. Pixl is not a Peppol Authority and does not administer the Peppol network. The interoperability of messages exchanged via Peppol depends, in particular, on the compliance of recipients with the technical specifications of the network. Pixl cannot be held liable for malfunctions, delays or non-delivery attributable to the Peppol network itself or to other participants.

12. Intellectual property

Pixl retains all intellectual property rights relating to the Service, including the software, interfaces, databases and documentation. For the duration of the subscription, the Customer is granted a personal, non-exclusive and non-transferable right of use. The Customer retains full ownership of its Data. For the duration strictly necessary to provide the Service, the Customer grants Pixl the hosting, processing and display rights needed to operate it.

13. Confidentiality

Each party undertakes to preserve the confidentiality of non-public information communicated by the other party in connection with the performance of the contract, for the duration of the contract and for five (5) years after its termination. This obligation does not apply to information that is already public, becomes public through no fault of the receiving party, or whose disclosure is required by law or a competent authority.

14. Changes to these Terms

Pixl may amend these Terms to reflect technical, regulatory or commercial developments. Any material change will be notified to the Customer by email or via the Service with thirty (30) days' prior notice. If the Customer does not accept the changes, it may terminate its subscription free of charge before the changes take effect.

15. Governing law and jurisdiction

These Terms are governed by Belgian law. Any dispute concerning their interpretation or performance falls within the exclusive jurisdiction of the courts and tribunals of the Brussels judicial district, without prejudice to any mandatory consumer protection provisions that may apply.
